Florida Attorney General James Uthmeier is taking decisive action against Key West following the city commissioners’ reckless decision to dissolve their collaboration with U.S. Immigration and Customs Enforcement (ICE) under the 287(g) program. This move not only defies state law but also places the city firmly in violation of its legal obligations to uphold immigration policies.

In a sternly worded letter to the Key West Commissioners, Uthmeier emphasized that by nullifying the police department’s existing 287(g) agreement, the city has effectively declared itself a sanctuary city. Florida law is clear—providing sanctuary to illegal immigrants is illegal. “Failure to take corrective action will result in enforcement of all applicable civil and criminal penalties, including removal from office,” he warned.

The 287(g) program empowers local law enforcement to enforce federal immigration laws. Florida mandates that cities actively cooperate with federal efforts to maintain the integrity of our immigration system. Yet, Key West not only failed to support this initiative but outright terminated a working agreement. This is not just bad policy; it is unlawful.

Uthmeier pointed to alarming statistics from recent arrests in the Florida Keys, where all ten individuals apprehended were convicted sex offenders. Further complicating matters, just last month, Border Patrol agents made additional arrests of illegal aliens, one with a violent criminal past and another charged with animal abuse. These incidents highlight the dangers that sanctuary policies can foster.

“Florida law unequivocally forbids sanctuary policies and mandates local governments to utilize ‘best efforts’ in assisting with federal immigration enforcement. Your recent action violated both laws,” Uthmeier asserted. He reiterated that non-compliance will lead to rigorous penalties for the commissioners, enforcing accountability for their decisions.

In striking contrast, the Fort Myers City Council shows a commitment to proper enforcement, having recently approved a renewed partnership with ICE after aligning with the state’s directives. This exemplifies responsible governance—an approach Key West should reconsider immediately.

Uthmeier’s warning is a wake-up call, compelling local leaders across Florida to prioritize legal compliance and public safety over misguided and politically motivated decisions. The rule of law must prevail, and it’s time for Key West to regain its footing by adhering to state mandates regarding immigration enforcement.
