Democrats’ Push for Judicial Warrants Will Cripple ICE Overnight

Democrats are poised to gut America’s immigration enforcement by forcing ICE agents to secure judicial warrants for every arrest. The consequence is brutal and immediate: up to 90 percent of removals grind to a halt the moment this policy takes effect.

This isn’t about due process. It’s a political weapon designed to guarantee mass amnesty.

Under current law, ICE relies on swift administrative warrants—simple, probable-cause orders that let agents arrest and deport illegal entrants before they commit new crimes. Swap those for full-blown judicial warrants, and every arrest request must crawl through a federal courtroom.

ICE veterans warn that judges will be swamped. Millions of routine I-205 warrants will clog dockets alongside complex criminal cases. Meanwhile, illegal entrants and visa overstays slip through the cracks, safe from removal.

Homeland Security insiders confirm the sabotage: “We’d lose the ability to round up single-status crossers, visa overstays, even repeat border-jumpers who haven’t yet committed a new felony,” says a senior ICE official. “It’s the equivalent of asking for a search warrant before pulling someone over for speeding.”

New rule or not, state and local crimes vanish from ICE’s radar. If an illegal alien crashes drunk in Minnesota, gets charged with DUI, posts bond and walks free, ICE can do nothing. No warrant, no arrest—regardless of the carnage left behind.

Behind the scenes, DHS attorneys warn Congress: our detention centers aren’t built for this. Courts lack the manpower. Border Patrol will face mass releases. Illegal entry arrests under 8 U.S.C. § 1325 will collapse into chaos.

The Democrats’ real objective is crystal clear: secure de facto amnesty for millions who flooded in under President Biden. They’re willing to tank the government to force it.
